By accessing or using Pagerly ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Pagerly is an email notification service that monitors your email metadata (sender addresses and subject lines) and places phone calls to alert you when emails matching your configured rules are detected. The Service is designed to help you stay informed about important emails.

3. Important Limitations & Disclaimer

Please read this section carefully:

  • Pagerly is a supplementary notification tool only. It is not a replacement for security measures provided by your financial institutions, healthcare providers, employers, or other service providers.
  • You must continue to use all security measures recommended by your service providers, including but not limited to: multi-factor authentication (MFA), strong passwords, regular account monitoring, and official notification channels.
  • The Service may experience downtime, delays, or failures due to technical issues, maintenance, third-party service outages (including email providers and phone carriers), or other unforeseen circumstances.
  • We cannot guarantee delivery of all notifications. Email delays, spam filtering, network issues, and other factors outside our control may affect notification timing or delivery.
  • You should not rely solely on Pagerly for time-sensitive or critical notifications. Always maintain direct access to your accounts and enable notifications through official channels.

4. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PAGERLY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, data, or business opportunities
  • Financial losses resulting from missed, delayed, or failed notifications
  • Unauthorized access to your accounts, regardless of whether you received a notification
  • Any damages arising from service interruptions, delays, or failures
  • Actions taken or not taken based on notifications received through the Service

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

5. No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

6. User Responsibilities

You agree to:

  • Provide accurate phone number and account information
  • Maintain the security of your Pagerly account
  • Continue using security measures recommended by your service providers
  • Regularly verify that your notification rules are working as expected
  • Not use the Service for any unlawful purpose
  • Not attempt to interfere with or disrupt the Service

7. Subscription and Payments

The Service is offered on a paid subscription basis. Current pricing is available on our website. Subscriptions automatically renew unless cancelled. You may cancel at any time through your account settings. Refunds are provided at our discretion for unused subscription periods.

8. Service Limits

The Service includes limits on usage, including up to 10 phone calls per day and up to 5 custom notification rules. These limits may change at our discretion with reasonable notice.

9. Account Termination

We reserve the right to suspend or terminate your account for violations of these terms, abuse of the Service, or for any other reason at our discretion. You may terminate your account at any time by contacting support.

10. Changes to Terms

We may update these terms from time to time. We will notify you of significant changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the updated terms.

11. Governing Law

These terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
